Ratio Decidendi

A notice of appointment of receivers executed outside Zambia is a 'document' under Section 2 of the Authentication of Documents Act and must be authenticated before it can be used in Zambia. Authentication cannot operate retrospectively; thus, any actions taken before authentication are invalid for statutory purposes. The High Court erred in equating the Act with the Lands and Deeds Registry Act and in holding that authentication had retrospective effect.
