  2. 2 Whether the prosecution proved its case beyond reasonable doubt
  3. 3 Whether inconsistencies in prosecution evidence were fatal to the case

Ratio Decidendi

The appellants were properly identified by PW1 and PW4, who knew them well and observed them under sufficient lighting during the attack. The possibility of an honest mistake was ruled out. The inconsistencies in the prosecution evidence were minor and did not affect the core elements of the offences. The appellants' own evidence placed them at the scene. The prosecution proved beyond reasonable doubt that the appellants participated as principals or accessories in the murder and aggravated robbery. The sentences were reviewed, with the sentence for aggravated robbery enhanced to life imprisonment with hard labour, and the death penalty for murder maintained.
