Ratio Decidendi

The insurer's liability is limited to the pre-accident market value of the vehicle, subject to the policy limit, and does not extend to loss of use or business unless expressly covered by the policy. The Deputy Registrar erred in awarding replacement value based on a newer model and in awarding loss of use without sufficient proof. A consent judgment cannot expand the insurer's liability beyond the policy terms.
