Ratio Decidendi

The Local Government Act No. 2 of 2019, which came into force before the hearing, now governs the tenure and eligibility for re-election of deputy mayors and deputy council chairpersons. The previous law (including section 17 of the Local Government Act as amended by Act No. 6 of 2010) was repealed and is no longer applicable. The new Act prescribes a tenure of two and a half years, with eligibility for one further term, and does not bar incumbents from seeking re-election.
