Ratio Decidendi

The appeal was dismissed because the court found that although the first respondent knew of the distribution of maize and fertilizer, there was no evidence of his consent or approval, and the distribution was a government programme not requiring his approval. The distribution was restricted to Mumba village, did not affect the result in the whole constituency, and the appellant did better in that village. Therefore, the requirements for nullification under Section 18(2)(c) and 18(4) of the Electoral Act were not met.
