  1. 1 Whether the Bundabunda Chieftainship system of succession is rotational
  2. 2 Whether the Kashimbi family are eligible to ascend to the Bundabunda throne
  3. 3 Which family lineage should ascend to the throne

Ratio Decidendi

The Bundabunda chieftainship system of succession is rotational among the Mulonga, Tubi-Kalifu, and Kashimbi families. The Kashimbi family is eligible to ascend to the throne, and the 1st appellant, Matthews Musona, is the duly selected successor. The lower court erred in limiting rotation to only two families and in relying solely on the 1972 family tree, which was contradicted by other credible evidence, including the existence of ten clay pots representing past chiefs and the memorandum of understanding. The installation of Fickson Chikweleti was properly annulled, and the chieftaincy should now rotate to the Kashimbi family.

Court Disposition

Appeal allowed in part; lower court's decision set aside in part; Bundabunda chieftaincy to rotate to the Kashimbi family; each party to bear its own costs.

Orders

  • The Bundabunda chieftaincy should rotate to the Kashimbi royal family, with Matthews Musona as the successor.
  • Each party to bear its own costs.
