The complainant was dismissed without being given an opportunity to be heard, in breach of natural justice and section 36(3) of the Employment Act. The reason for dismissal (loitering) was unsubstantiated as the complainant was performing work-related duties. The dismissal was therefore unfair, entitling the complainant to damages and the balance of notice pay. Claims for leave pay and benefits for years worked were not proven and are dismissed.
