Severance pay under Section 54 of the Employment Code Act No. 3 of 2019 is only payable where the contract of employment ends by termination (other than at the instance of the employee) or expiration, and not where the contract ends by dismissal for misconduct. The express mention of termination and expiration as qualifying modes of separation excludes dismissal, which is a distinct mode involving disciplinary action. Therefore, an employee summarily dismissed for misconduct is not entitled to severance pay.
