The acts of philanthropic borehole sinking were not directly attributable to the Respondent and did not amount to corruption. The evidence of canvassing at a polling station was insufficient to show it affected the election outcome. The Respondent was not a UPND member at the time of nomination and thus qualified to stand as an independent. Other alleged misconduct was not shown to have affected the majority of voters in the constituency.
