Ratio Decidendi

The High Court has jurisdiction to hear and determine claims for trespass and protection of surface rights, even where mining rights are also in issue, and the statutory dispute resolution mechanism under the Mines and Minerals Development Act does not oust the common law right to sue for trespass. The appellant, as purchaser in possession, was entitled to bring the action notwithstanding the absence of a certificate of title. The lower court erred in dismissing the action as an abuse of process and for want of jurisdiction.
