The Defendant failed to substantially perform the contract for sale of land, having only paid minor amounts towards the purchase price and not completing the transaction. She therefore had no enforceable interest to justify the caveat or to warrant specific performance. The only sums to be refunded are those paid directly at the Plaintiffs' request. The Plaintiffs failed to prove damages for frustration of a subsequent sale. Each party to bear its own costs.
