The Respondent, through his agents, made false and defamatory statements against the Petitioner during a widely broadcast radio interview, branding him a thief without justification. This conduct, in a rural constituency, was likely to influence the electorate and prevent them from voting for the Petitioner. The Petitioner proved this misconduct to the required legal standard. The violence alleged at polling stations was not sufficiently linked to the Respondent or his agents to the required standard. However, the proven defamation and incitement were sufficient to void the election under Section 97(2)(a) of the Electoral Process Act No. 35 of 2016.
