Ratio Decidendi

The house in dispute did not form part of the late husband's estate as at the date of his death there was no contract of sale between him and Zambia Railways Limited; therefore, the Interstate Succession Act did not apply to the house. The sale of the house is governed by Zambia Railways Limited policy, which entitles the registered spouse and children above 16 years to purchase the house. The sale of the house by the administrator to third parties was invalid as he was not the registered owner.
