Ratio Decidendi

The 1st Plaintiff was the causa causans of the sale of the Defendant’s house to Mrs. Lillian Nkhoma, having introduced Dr. Nkhoma to the property, which led to the sale. There was a credible agreement for a 5% commission between the 1st Plaintiff and the Defendant. The 2nd Plaintiff lacked locus standi as he was not authorized by the Defendant. The 1st Plaintiff is entitled to K42,500,000.00 as commission, with interest and costs.

  • The Defendant shall pay the 1st Plaintiff K42,500,000.00 as commission.
