Procedural Posture

Criminal Appeal / Supreme Court Judgment on Appeal From High Court Conviction and Sentence

  1. 1 Whether the appellants were entitled to a reduction of the charge from murder to manslaughter on grounds of provocation
  2. 2 Whether the appellants could rely on the defence of property to justify their actions
  3. 3 Whether the doctrine of common purpose was properly applied to all appellants

Ratio Decidendi

The appellants' denial of involvement in the killing was incompatible with the defences of provocation and defence of property. Even if provocation was considered, the reaction was not immediate, there was sufficient cooling-off time, and the retaliation was disproportionate. The defence of property was not available as the appellants were not defending their own property, and the force used was excessive. The doctrine of common purpose properly attached liability to all appellants. The conviction and sentence for murder were upheld.

Court Disposition

Appeal dismissed; conviction and sentence confirmed

Orders

  • The appeal is dismissed in its entirety.
  • The conviction and sentence of the lower court are confirmed.
