Ratio Decidendi

The 1st Respondent abused public resources and benefited from an unfair advantage as a Cabinet Minister during the campaign period. Violence and intimidation by PF cadres, lack of transparency and procedural lapses by the Electoral Commission, and denial of equal access to polling stations to the Petitioner, cumulatively prevented the majority of voters from freely electing their preferred candidate and affected the result of the election. The election was not conducted in accordance with the law and principles of fairness, and is therefore null and void.
