Ratio Decidendi

Retirement in national interest is a form of retirement contemplated under Article 189 of the Constitution, entitling the Petitioner to be retained on the payroll and to receive allowances that were part of his salary at retirement until payment of terminal benefits. However, section 18 of the NAPSA Act is not unconstitutional as it provides necessary controls for pension fund sustainability and does not contravene Articles 187 and 189; thus, the Petitioner is not entitled to immediate payment of pension from NAPSA unless statutory requirements are met.
