The Tribunal erred in nullifying the appellant's election as the respondent failed to adduce cogent evidence to prove, to the required high standard, that the appellant or his agents committed electoral offences of bribery, corruption, or misconduct, or that such acts were widespread enough to have prevented the majority of voters from electing their preferred candidate. The findings of the Tribunal were not supported by the evidence and were perverse. The appellant's failure to file an answer did not relieve the respondent of the burden of proof.
