Procedural Posture

Civil Trade Mark Infringement / Judgment

  1. 1 Whether the Plaintiff owns a valid and registered trade mark
  2. 2 Whether the Defendant used the same or a similar trade mark in commerce or course of trade without the Plaintiff's consent
  3. 3 Whether the Defendant's use of the trade mark caused a likelihood of confusion in relation to any of the goods for which it is registered

Ratio Decidendi

The Plaintiff failed to prove, on the balance of probabilities, that the Defendant used its registered trade mark in the course of trade without consent. The manufacturing of sample bags by the Defendant with the Plaintiff's authority does not constitute infringement. There was no evidence linking the Defendant to the infringing acts at Kasumbalesa or to any unauthorized use in commerce. Consequently, the Plaintiff's claims fail.

Court Disposition

Plaintiff's claim dismissed with costs to the Defendant.

Orders

  • Plaintiff's entire claim is dismissed.
  • Costs to the Defendant, to be taxed in default of agreement.
