The respondent's dismissal was wrongful due to lack of due process and failure to provide an opportunity to be heard, entitling him to damages. The lower court was justified in considering unfair dismissal as a remedy under the Industrial and Labour Relations Act, even if not specifically pleaded, to do substantial justice. However, the award of 12 months' salary as damages was excessive and is reduced to 8 months, and the award of costs was improper as there was no evidence of vexatious conduct.
