Ratio Decidendi

The Supreme Court held that the legal authority to award hunting concessions was vested in the Zambia Wildlife Authority (ZAWA), not the Zambia National Tender Board (ZNTB). ZNTB only approved ZAWA's recommendations and granted authority to award, but did not itself award the concessions. The tender process was found to be lawful and fair, and the applicants' lease renewal rights were extinguished by frustration due to the government ban. The application for judicial review was properly refused, though for different reasons than those given by the trial judge.
