Procedural Posture

Originating Summons (family/probate) / Judgment

  1. 1 Whether the Applicants are entitled to an inventory and account of the deceased's estate
  2. 2 Whether the Respondents have failed in their duties as Administrators
  3. 3 Who are the rightful beneficiaries and their proportions

Ratio Decidendi

Applicants are entitled to an updated inventory and account of the deceased's estate as Administrators failed to fully discharge their statutory duties, particularly regarding transparency, disputed assets, and inclusion of non-beneficiaries. The adopted child's inheritance rights remain unaffected by the annulment of the marriage. Ex-gratia inclusion of additional beneficiaries is unenforceable without unanimous consent. The Respondents cannot withhold the 1st Applicant's share absent a court order or properly pleaded counterclaim. Distribution of the estate is stayed pending updated accounts and resolution of outstanding issues.

Court Disposition

Partly allowed; orders granted as specified; distribution stayed pending updated account; no order as to costs.

Orders

  • Respondents to file updated inventory and account of administration within 90 days.
  • Distribution of estate halted until updated inventory and account are filed and outstanding issues resolved.
