Civil Appeal / Judgment on Appeal

  1. 1 Whether the appellant was entitled to notice pay upon summary dismissal
  2. 2 Whether deduction of K17,000 from appellant's terminal benefits was lawful
  3. 3 Whether appellant was entitled to overtime and public holiday/Sunday compensation

Ratio Decidendi

The appellant, having been summarily dismissed after a disciplinary process for misconduct, was not entitled to notice pay or payment in lieu. The deduction of K17,000 was lawful as her actions amounted to dishonesty, and the relevant statutory protections for wage deductions did not apply post-dismissal or to her role. Overtime and public holiday compensation claims failed as the statutory instrument did not apply to her management-level position. The claim for unfair dismissal was dismissed as due process was followed. The only successful claim was for issuance of a release letter.
