Ratio Decidendi

The High Court has jurisdiction to grant bail in all cases, including murder and treason, under s.123(3) of the Criminal Procedure Code, and the exclusion in s.123(1) does not limit this power. An inquest cannot be held or continued until after the conclusion of criminal proceedings, per s.6 of the Inquest Act. Procedural irregularities in the reference do not bar the Supreme Court from hearing the appeal as the substance falls within constitutional provisions for reference and appeal.
