Ratio Decidendi

The Plaintiff satisfied the first two requirements for a Mareva injunction: a debt due and owing and assets within the jurisdiction. However, the Plaintiff failed to satisfy the third requirement of showing grounds for believing the Defendant intends to dispose of assets to avoid execution, as the judgment sum was already paid into court and the Defendant offered to pay interest and costs pending appeal. The original Mareva order was overly onerous and defective, but the variation allowing use of assets in the ordinary course of business and providing for cessation of the order upon payment of interest and costs into court was appropriate. The varied Mareva order is confirmed.
