The trial judge was correct in dismissing the application for medical examination as there was no evidence or behaviour suggesting the appellant was of unsound mind, and the appellant's epilepsy did not amount to insanity. The appellant's ability to recall and narrate the events to the police undermined his claim of memory loss. Epilepsy and suspicion of infidelity do not constitute extenuating circumstances. The conviction and mandatory death sentence are upheld.
