  1. 1 Whether the accused caused the death of Prudence Lumano by an unlawful act with malice aforethought
  2. 2 Whether circumstantial evidence was sufficient to convict the accused

Ratio Decidendi

The accused persons' explanations for possession of the deceased's phone were not reasonably true or probable, as the deceased was shown to be alive and using her phone after the time the accused claimed to have found it. The accused were in the vicinity of the crime, had the opportunity to commit the offence, and their conduct after the fact indicated guilty knowledge. The only reasonable inference from the circumstantial evidence is that the accused caused the death of Prudence Lumano with malice aforethought.
