The interest provisions in clause 4 of the Loan Agreement are illegal and unenforceable as they offend sections 10 and 15(1) of the Money Lenders Act by providing for compound interest and an excessive rate. The Applicant is entitled to recover the outstanding principal (after accounting for payments made) with simple interest at the statutory rate, and the security over the motor vehicle is valid as an equitable mortgage.
