Ratio Decidendi

A registered proprietor under a certificate of title is entitled to exclusive possession and enjoyment of their land. Mistaken developers or occupiers, even if acting in good faith, acquire no rights against the title holder and must vacate the land. Any improvements made become part of the land and vest in the owner. Damages for trespass and loss of use are payable by the trespassers, not the local authority, though the trespassers may seek indemnity from the authority if warranted.
