Ratio Decidendi

The respondent imposed the wrong penalty by dismissing the appellant instead of discharging her as provided under clause 1.6 of the Grievance and Disciplinary Procedure Code. However, since the appellant was guilty of desertion and the respondent substantially complied with procedural requirements, no injustice was suffered. The dismissal is substituted with discharge, entitling the appellant to one month gross salary with interest.
