Ratio Decidendi

The burden to account for all rent received and that which ought to have been received during possession of the mortgaged property lies with the mortgagee, not the mortgagor. The lower court erred in holding the appellant liable for a fixed sum without a proper account. The amount due must be determined after the respondent renders a full account, including rent and the purchase price of the property.
