The issue of whether the Tafuna Chieftaincy succession is patrilineal or matrilineal is not a constitutional question. The second relief sought is criminal in nature and has already been adjudicated by the High Court and Court of Appeal. The petition is also barred by the principle of res judicata as the issues have previously been determined between the parties.
