Ratio Decidendi

The convictions based on single identifying witnesses were safe as the witnesses had ample opportunity to observe the appellants and the possibility of honest mistaken identity was ruled out. However, the conviction and sentence for armed aggravated robbery under Section 294(2)(a) was a misdirection as the appellants were not properly charged or put on notice, and there was no direct evidence of use of a firearm. The proper conviction is for aggravated robbery under Section 294(1), with a sentence of 30 years imprisonment with hard labour.
