Ratio Decidendi

The lower court erred in applying a 50/50 division of the matrimonial home without adequately considering the financial circumstances and contributions of both parties. The respondent is entitled to three-eighths of the value of the matrimonial home or K17 million, whichever is greater, and equal share of other family assets acquired during marriage. The order for refund of the Mazda purchase price is quashed as the proceeds were used for the benefit of the family.
