The court found that the applicant's explanations for non-compliance were not credible, and that the right to a fair hearing does not override the obligation to comply with procedural requirements. The court further held that its inherent jurisdiction to reopen final decisions is to be exercised sparingly and only in cases where a party, through no fault of their own, has been subjected to an unfair procedure, which was not established in this case.
