Ratio Decidendi

Clause 2(c) of the employment contract expressly excluded implied renewal by continued service; the respondent's continued employment after expiry did not create a new contract or entitle him to additional benefits. The respondent was only entitled to pro-rata remuneration for the period worked beyond the contract term. The trial court erred in granting entitlement to purchase a second vehicle and in not awarding costs to the appellant.
