Procedural Posture

Civil Appeal / Judgment on Appeal From Refusal to Review High Court Decision

  1. 1 Whether the lower court erred in refusing to review its decision of 17th June, 2024
  2. 2 Whether the lower court had jurisdiction to hear the complaint filed out of time and during court vacation

Ratio Decidendi

The oral order granting leave to file the complaint out of time was made on 1st December, 2020, and the subsequent perfection on 21st December, 2020, did not affect the validity of the complaint filed on 14th December, 2020. There was no sufficient cause for review under Order 39, and the lower court had jurisdiction as leave had been properly granted. Filing during court vacation was authorized by the leave order, and the Industrial and Labour Division's focus on substantial justice justified the process.
