Procedural Posture

Civil Appeal / Judgment on Appeal

  1. 1 Whether the lower court erred in granting a writ of possession contrary to a consent order.
  2. 2 Whether a writ of possession can issue without proof of service on persons in possession.
  3. 3 Whether the lower court had jurisdiction to set aside a consent judgment without a fresh action.

Ratio Decidendi

The lower court erred in granting a writ of possession to the 1st and 2nd respondents over properties that had been reinstated to the appellant by a consent order, without a fresh action to set aside that order, and without proof of service of proceedings on persons in possession. The writ of possession was therefore irregular and liable to be set aside.
