Ratio Decidendi

The Arbitration (Court Proceedings) Rules provide a complete code for the registration and enforcement of arbitral awards, including service outside jurisdiction. There is no requirement for leave to issue process for service outside jurisdiction prior to filing for registration. However, the Registrar exceeded his jurisdiction by including in the registration order a direction to amend the share register, which amounted to interpreting or altering the arbitral award, a function reserved for the arbitral tribunal.
