Procedural Posture

Election Petition / Judgment

  1. 1 Whether the Respondent was duly and validly elected as Member of Parliament for Sinazongwe Constituency
  2. 2 Whether widespread electoral malpractices, corrupt and illegal practices occurred with the knowledge and consent of the Respondent or his agents
  3. 3 Whether such malpractices prevented the majority of voters from electing their preferred candidate

Ratio Decidendi

The Petitioner failed to prove to the requisite standard that the alleged widespread electoral malpractices, corrupt and illegal practices were committed by the Respondent or with his knowledge and consent or approval, or that such acts prevented the majority of voters in Sinazongwe Constituency from electing their preferred candidate. The evidence showed that most witnesses who experienced violence or intimidation still voted for their preferred candidate, and the acts complained of were not sufficiently widespread or attributable to the Respondent or his agents to warrant nullification of the election.

Court Disposition

Petition dismissed. Respondent declared duly elected Member of Parliament for Sinazongwe Constituency.
