The complainant's summary dismissal or discharge was wrongful and unfair because he was charged with a non-existent offence ('intimidation') not provided for in the respondent's disciplinary code, and the disciplinary process did not follow the prescribed procedure. The only valid offence was 'misconduct likely to bring the company into disrepute,' for which the appropriate sanction was a warning and suspension, not dismissal. The complainant is entitled to reinstatement and payment of all salaries and allowances from the expiry of suspension to reinstatement.
