Procedural Posture

Criminal Appeal / Judgment on Appeal

  1. 1 Whether the identification evidence was reliable given the circumstances of the robbery and the identification parade irregularities
  2. 2 Whether the recovery of the gun and coats from the 1st appellant corroborated the identification evidence
  3. 3 Whether the conviction for armed aggravated robbery was proper given the gun was not a firearm as defined by law

Ratio Decidendi

The identification evidence was reliable due to the prolonged interaction and sufficient lighting during the robbery, corroborated by the recovery of the gun and coats. However, as the gun was not a firearm within the meaning of the Firearms Act, the conviction for armed aggravated robbery under Section 294(2) of The Penal Code was improper. The proper conviction is for aggravated robbery under Section 294(1).
