Ratio Decidendi

The respondent failed to demonstrate any lawful or justifiable interest in the property as required by section 76 of the Lands and Deeds Registry Act and did not discharge the burden of proof under section 81 to justify the continued registration of the caveat. There is no legal requirement for the Commissioner of Lands to consult the respondent before alienating land in a National Park, and the applicant's certificate of title stands as conclusive evidence of ownership. The caveat must therefore be removed.

Court Disposition

Caveat ordered removed; costs awarded to applicant; leave to appeal granted.

Orders
