The complainants were not declared redundant as their positions were not abolished and the requirements of redundancy under section 55(1) of the Employment Code Act were not met. However, the respondent failed to give requisite notice and did not pay for accrued leave or gratuity post-9 May 2019, entitling the complainants to one month salary in lieu of notice, payment for accrued leave days, and gratuity for the period after the Employment Code Act came into effect.
