Ratio Decidendi

The appeal was allowed on the basis that the Respondent failed to comply with the mandatory requirements of Order 6 Rule 1 of the High Court Rules by not attaching a Statement of Claim and attendant documents to the application for leave to serve out of jurisdiction, and that the correct mode of commencement for challenging the Registrar's decision was by appeal under Section 341 of the Companies Act. The lower court erred in finding that the procedure was properly followed.
