Ratio Decidendi

The trial court's findings of negligence against the Defendant's driver were not supported by evidence. The only eyewitnesses were the Defendant's witnesses, whose evidence was improperly dismissed. The physical evidence and credible testimony showed the Plaintiff's driver was in the wrong lane and at fault. The trial court misapprehended the evidence and made an unbalanced evaluation, warranting appellate interference.
