Ratio Decidendi

The writ of FiFa was irregular because it was issued against all three Respondents, including the 1st Respondent, contrary to the judgment which only permitted enforcement of personal guarantees against the 2nd and 3rd Respondents. Enforcement against the 1st Respondent should proceed through foreclosure and sale of the mortgaged property. The Applicant's assertion that the mortgaged property was insufficient to satisfy the debt was unsupported by evidence.
