Ratio Decidendi

The court found no credible evidence of misrepresentation or undue influence by the Applicant or 2nd Respondent in relation to the third party mortgage of 22nd July 2013. The 1st Respondent voluntarily entered the transaction, had prior experience with mortgages, and received a pecuniary benefit. The Applicant did not breach any duty to advise the 1st Respondent. However, the further charge and deed of guarantee were found to be forgeries and unenforceable. The Applicant is entitled to judgment for the sum of ZMW2,218,483.35 plus interest against the 3rd Respondent, with foreclosure rights against the mortgaged properties limited to the amounts secured by valid instruments.
