Ratio Decidendi

The third party mortgage dated 22nd July 2013 is valid and enforceable against the 1st and 3rd Respondent as there was no credible evidence of misrepresentation or undue influence by the Applicant or 2nd Respondent. The 1st Respondent voluntarily entered the transaction, was an adult of full capacity, and had previously pledged the property. The further charge and deed of guarantee were found to be forgeries and are unenforceable against the 1st Respondent. The Applicant is entitled to judgment for the outstanding sum, foreclosure, and sale of the mortgaged properties in the event of default.
