Ratio Decidendi

The appellant, through its Managing Director, engaged in a series of acts and words of abuse and failed to promptly and reasonably handle the respondent's grievance, breaching the implied term of mutual trust and confidence. The failure to call the Managing Director to rebut the allegations was fatal. The cumulative breaches entitled the respondent to resign and amounted to constructive dismissal. The trial court's findings were supported by the evidence and not perverse. However, the order for costs was set aside as there was no evidence of unreasonable conduct by the appellant.
